General conditions of employment

All foreign-domiciled employers who post employees to Germany are required by Article 2 of the Arbeitnehmer-Entsendegesetz - AEntG to guarantee that they provide the same conditions of employment as those generally laid down in German legal and administrative regulations, with which domestically-domiciled employers must equally comply. Specifically, these regulations cover:

  1. Minimum wage rates, including overtime rates,
  2. Minimum paid annual holiday,
  3. Maximum working hours and minimum rest periods,
  4. Conditions for the supply of labour, in particular by temporary employment agencies,
  5. Health, safety, and hygiene in the workplace
  6. Protective measures relating to working and employment conditions for pregnant women, women who have recently given birth, children, and young people,
  7. Equal treatment of men and women and other anti-discrimination provisions.
