Publications or media likely to harm minors and unconstitutional publications

To protect public order and morality the introduction into, and export from, Germany of publications/media that are likely to harm minors or have unconstitutional content must be monitored.

Pursuant to Section 11 (3), German Criminal Code (Strafgesetzbuch - StGB), the term "publications" includes sound and image storage media, data storage media, images and other representations.

While the term "publications" (Schriften) is used throughout the respective provisions in the German Criminal Code, the Youth Protection Act (Jugendschutzgesetz - JuSchG) uses the term "media" (Trägermedien) (see Section 1 (2), JuSchG). As far as content is concerned, however, both terms refer the same range of goods.
