Application of the Minimum Wage Act in cross-border passenger and goods road transport

In principle, the Minimum Wage Act applies equally to all modes of transport in the case of international passenger and freight transport, as well as to undertakings established in the EU or a third country. However, due to specific rules, in particular for the road transport sector, there are some exceptions.

Posting declarations in the road transport sector for employers established in another Member State of the European Union or the European Economic Area must be submitted via the interface to the Internal Market Information System ("IMI") in accordance with section 16(2) MiLoG and section 18(2) AEntG.

Road transport undertakings established in a third country continue to submit notifications or assignment notifications via the Minimum Wage Notification Portal. Road transport companies based in the United Kingdom may alternatively submit notifications via IMI.
